Dangane da wannan Mas'ala ta hukuncin auren Matar da aka ɗauki tsawon lokaci ba a san inda Mijinta yake ba, wataƙila harma an haƙura an fidda rai dashi har ta auri wani Mijin, to kuma kwatsam bayan tayi aure sai ga tsohon Mijinta ya dawo, to wai yanzu Matar ta waye acikin su biyun? Alal-Haƙiƙa Malamai ma'abota Ilmi sunyi maganganu daban-dabam akan wannan Mas'ala,

(1)-Ƙauli na farko shine, mafi yawan Malaman dake Mazhabobin

Hanābila, sun tafi ne akan cewa shi wannan tsohon mijin nata na farko da yadawo shine Mijinta, domin asali dama Matarsace, danhaka auren da aka ɗaura mata da wancan Mijin na biyu, to a yanzu sunansa Ɓātaccen aure domin ba a buƙatar wai sai yace ya saketa, amma idan Mijin na biyu ya sadu da ita to shikenan taci sadaƙinta, idan kuma sun haifi 'ya'ya tare dashi to za a jingina masa 'ya'yansa ne zuwa gareshi amatsayin 'ya'ya na halal, za suci gadonsa shima zai iya cin gadonsu, saboda kasancewar (Shubuhar) da ta faru a tsakani, sai dai kawai yanzu ita Matar zata zauna ne tayi iddar wancan Mijin na biyu, daga nan sai suci gaba da zama tare da asalin Mijinta ba tare da an sake wani sabon ɗaurin aure ba, sai dai Mazhabin Hanafiyya sun kafawa matar da aka nemi mijinta aka rasa sharaɗin cewa ba zatayi wani aure ba har sai in ta samu labarin tabbacin cewa Mijin nata ya mutu ko kuma ya aiko mata cewa ya saketa, daga cikin hujjojin Malaman dake kan fahimtar cewa mijinta na farko shine mijinta bawai miji na biyu ba, sun kafa hujja da abinda aka ruwaito daga dukkan wadannan Sahabbai

Cewa dukkansu sun yi hukunci ne akan cewa Mijin farko shine Mijinta, kuma ba a samu wani Sahabi ko guda ɗaya da ya saɓa musu akan hakanba, Aʟʟαн(ﷻ) Yaƙara yarda agaresu baki ɗaya,

(1)-Ƙauli nabiyu kuma shine, Mazhabin Mālikiyya sun tafi ne akan cewa idan Mijinta na farko ya dawo bayan Matar ta gama iddarsa hartayi aure kuma Mijin ya sadu da ita, to a yanzu kam bashi da iko akanta tunda tayi aure danhaka sukace Mutumin da ta aura na biyun shine Mijinta, sai dai sukace idan miji na biyun bai kai ga saduwa da ita ba to Mijita na farko shine yafi cancanta da ita,

To amma dai magana mafi inganci kamar yadda mafi yawan Malamai suka rinjayar itace, wannan Matar tana ƙarƙashin igiyar auren Mijinta ne na farko da yadawo:

Wannan kenan, to amma idan ya dawo ya tarar har an riga an rabe dukiyarsa a matsayin gado to yanzu ya za ayi kenan? Dukkan Mazhabobin nan guda huɗu sunyi ittifaki akan cewa za a dawo masa da dukiyar sa ne, to amma idan ya kasance dukiyar ta salwantafa ya zama babu ita tuni an riga an kashe ta? A nan sai Malamai sukayi Saɓani, mafi yawan Malamai sukace sai an rama masa an biya shi dukiyarsa, amma Mazhabin Hanafiyya sukace babu wata ramuwa da za ayi masa, kawai abinda yazo ya samu ya karɓa amma wanda ya salwanta kuma shikenan, sai dai magana mafi inganci idan wanda ya ɓata kuma yadawo gida to za a dawo masa da dukiyarsa ne da kuma Matarsa,
